Injuries Lasting Less than 12 Months
Wife broke ankle and will be out of work for 3 months can she get disability?
No. You have to have a condition that has lasted 12 months or is expected to last 12 months and prevent you from doing work. I have had cases when someone smashed their leg in a wreck and they can’t go back to work for 11 months they will still be denied. According to social security you are not disabled. You do not have to wait to apply for disability. If it is a weight bearing bone it will meet a listing. You have to stay off the leg to get the bone to mend. You can only qualify for disability if it is 12 months or more.
